Conflict of Interest

The chair of the board is reported to have various projects in Miami Springs. He may be a great guy, smart architect and honest resident but it is clearly a conflict of interest. Sure he can recuse himself at times but that is not enough. People with conflicts of interest can be exceedingly honest and attempt to avoid ethical problems but the conflict remains and perception makes it impossible to always appear fair. What if a variance is granted to a project he represents but not to a project that he is not involved in? Sure he can recuse himself but the denied party would have a case that the board showed bias to his project while denying the project to another applicant. It may not be true but the perception is there. The potential legal liability to the city is also there.

Another thing to consider with the variance. What happens when another property owner wants to do the same thing? Substitute residential for commercial. The city has established precedence. If the city denies the next request for a variance for the same reason can the developer sue? So after all these years of the city leaders squawking about needing more commercial tax base to relieve the residents of their high tax burden they are going backwards and contradicting their case. I don-t know enough about the details to say it-s a good idea or not but a couple of things come to mind. Commercial property can be revenue positive when it comes to tax revenue. Residential property not so. That is why you hear so much about increasing commercial tax base in MS. Not a sign of corruption there remember Ibarra is Rosie Buckner-s appointee after Martin was removed from the board and an actual practicing successful architect with actual clients. 2 additional units is preferable over commercial ? on the entire first floor. There is definitely more traffic brought by a bar or restaurant or two than 2 additional residential. Additionally they would be coming and going people that are unknowns yet have reason to be near your homes. How much traffic can two additional units really bring? Someone needs to get some sense knocked into them. The three stories are coming the question is will it be for 10 rental units or 12 residential condos with owners?

Reality

The reality is Butler can build a 3 story building with the bottom floor being commercial and the top floors apartments as it is today with no variances. Personally I live close by the property and I would rather have residents that live and own the condo pay taxes like I do rather than having some shady business with patrons coming and going loitering around not knowing who they are and some transient rental units on the 2nd and 3rd floor. Remember that we have a moratorium on the marijuana dispensary and if that-s lifted one could easily and legally set up shop there on the first floor a few houses away from me and I can do nothing about it. I-d rather have 12 new condo owners than transients and patrons coming and going hanging around my home. People here can-t seem to see the forest beyond the trees.

According to current code he can build an 8-10 residential units and a commercial componet on the first floor without any variance at all. The residents voted 10 years ago a charter amendment limiting residential buildings to 3 stories, here comes someone that wants to build just that and now the residents are against what they actually approved in the cherater amendment!!! A 12 unit residential project has LESS traffic than if a commercial component was added? Beautiful Miami Springs is a quiet residential community located in the heart of Miami-Dade County, Florida. Literally, just minutes away from anything in Miami, it's a slow paced oasis within the larger hustle and bustle of greater Miami.

Miami Springs was founded in 1926 by Glenn Curtiss, also known as the "Father of Naval Aviation." Miami Springs is a middle to upper middle class neighborhood with a mix of blue collar and white collar workers. At the core of Miami Springs is a championship style 18 hole golf course that has hosted hundreds of tournaments and celebrities alike.

Miami Springs has a mix of homes ranging from modest to luxury. Most of the larger, luxury style homes can be found along the beautiful golf course.

Miami Springs has a row of hotels along NW 36 Street, adjacent to Miami International Airport. The proximity to the airport and the 10 - 15 minute distance to the Port of Miami Cruise Ships and South Beach makes Miami Springs a popular hotel destination for tourists from all across the globe.

MiamiSprings.com was created in 1997 by local businessman and Miami Springs resident, Nestor Suarez. Nestor loved the city he grew up in and created the first website dedicated to the Miami Springs and Virginia Gardens area. To this day, Mr. Suarez still operates the website providing local news, events, updates, and photos. The website also has a popular (and sometimes controversial) political forum where anyone can discuss current local issues, politics, ideas.
